Ethical [and Other] Issues Posed by Whistleblowers in Internal Investigations [& Compliance Programs] - Tuesday, May 8, 2018 2:00pm Session B

This panel will explore how the involvement of a whistleblower can impact an internal investigation and how the possibility of whistleblower allegations can inform company compliance programs.  Panelists will include representatives from the Commodity Futures Trading Commission’s Whistleblower Office, the Federal Energy Regulatory Commission’s Enforcement Division, the private bar, and in-house compliance counsel.  The panel will discuss ethical considerations involved in investigating whistleblower claims, including how to determine when and what to report to regulators, and in crafting compliance programs.  The CFTC’s recently updated Whistleblower Program Rules and advances technology and data analytics will help frame the discussion.  The panelists plan to use hypothetical fact patterns to make the discussion interactive, exploring with audience members how counsel advising energy companies should ethically handle these internal whistleblower issues.
